JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-01-2020 Petitioners seek bail in anticipation of their arrest in connection with Kahalgaon (Shiv Narainpur) P.S. Case No. 437 of 2019 registered for the offences punishable under Sections 147, 341, 323, 504, 506, 379, 385 and 387 of the Indian Penal Code.

Patna High Court CR. MISC. No.85675 of 2019(2) dt.22-01-2020 2/2 As per prosecution case, petitioners in order to grab the purchased land of the informant came variously armed and demanded extortion from the informant.

Submission of learned counsel for the petitioners is that a title suit is going on with respect to the land and earlier also they have been implicated at the instance of the informant. Heard learned APP also.

In view of above facts and circumstances, let petitioners, in the event of surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur, in connection with Kahalgaon (Shiv Narainpur) P.S. Case No. 437 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
