The petitioner is in custody since 14.08.2018 in connection with Kahalgawn N.T.P.C. P.S. Case No. 57 of 2018 for the offence registered under Sections 413, 414, 420 of the Indian Penal Code and Sections 25(1-b)a/26, 35 of the Arms Act.
Learned counsel for the petitioner submits that the recovery as alleged was not from the petitioner but from the possession of one co-accused, namely, Dibyansu Jha. It is further submitted that the entire story is false and the petitioner is a petty labourer and has been falsely implicated in connection with the present case on mere suspicion.
Considering the aforesaid facts and circumstances of
Patna High Court Cr.Misc. No.78403 of 2018(2) dt.28-01-2019 2/2 the case and the period of custody, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Kahalgawn N.T.P.C.
