2. Petitioners apprehend their arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

3. Total 50 liters of country-made liquor was recovered from a mango orchard.

4. Learned counsel for the petitioners submits that petitioners have been implicated in this case only on suspicion. Petitioners have got no concern with the alleged recovery. Though, petitioner no. 1 has got clean antecedent, but petitioner no. 2 is accused in two cases of similar nature.

5. Learned A.P.P. opposed the prayer for bail.

6. However, considering the fact that petitioner no. 2 has got two criminal antecedent of similar nature, his prayer for anticipatory bail is rejected.

7. Since petitioner no. 1 namely Chhatradhari Ray has got clean antecedent, in the event of arrest/surrender before the Court below within a period of eight weeks from today, he is directed to be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise Act, Jhanjharpur, District Madhubani in connection with Ghoghardiha P.S. Case No. 152 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
