The petitioners are apprehending his arrest in a case registered under Sections 147, 148, 149, 342, 323, 337, 353, 225, 506, 511 of the Indian Penal Code.
Allegation is that the accused persons including the
Patna High Court CR. MISC. No.81982 of 2019(2) dt.18-12-2019 2/3 petitioners and 150-200 unknown persons illegally blocked the main road and after seeing the police they were making hulla loudly. The accused persons tried to snatch accused Dilip Paswan and Lalo Paswan from custody of police and attacked with bricks on police force.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. It is alleged that the petitioner was also protesting on the road and for the said reason he has been made accused in this case. General and omnibus allegation has been made. No specific overt act is alleged against the petitioners. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st class, Khagaria in connection with Khagaria P.S. case No.163 of 2017,
