This application for anticipatory bail arises out of Bhargama P.S. Case No.90/2017, disclosing the offence under Sections 147, 148, 149, 341, 323, 324, 325, 427, 307, 379, 354(C), 504, 506 of the Indian Penal Code.

It is evident from the First Information Report that land dispute between the parties is the reason behind occurrence. The petitioners are female members of the same family.

Learned counsel for the petitioners has submitted that the injuries have been found to be simple in nature and two other persons have been allowed anticipatory bail by orders

Patna High Court CR. MISC. No.79386 of 2019(2) dt.18-12-2019 2/2 dated 13.08.2019 passed in Cr. Misc. No.50190 of 2019 and 12.10.2018 passed in Cr. Misc. No.56410 of 2018. Considering the aforesaid submissions and the fact that the similarly circumstantial co-accused persons have been allowed anticipatory bail, this application is allowed. Let the petitioners, above-named, in the event of their arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Chief Judicial Magistrate, Araria in Bhargama P.S. Case No.90/2017, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
