The petitioner apprehends his arrest in connection with N.T.P.C. P.S. Case No. 18 of 2018 registered for the offences punishable under Sections 457, 380, 411 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has been named by the co-accused, save and except that there is no material to connect the petitioner in the present case. It is submitted that nothing incriminating has been recovered from the house/possession of the petitioner. It is further pointed out that vide Annexure-2, co-accused has been granted anticipatory bail in Cr. Misc. No. 61157 of 2018. In the given facts and circumstances, where the

No.4940 of 2019(3) dt.14-02-2019 2/2 submission is that the petitioner's name has transpired in the confessional statement and the co-accused has been granted privilege of anticipatory bail, let the petitioner above named, in the event of his arrest or surrender within a period of four weeks from today, be enlarged on bail on execution of bail bonds of Rs. 15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with N.T.P.C. P.S. Case No. 18 of 2018, subject to the condition that the petitioner shall join the investigation by reporting to the Investigating Officer within a period of two weeks from today and shall co-operate in course of investigation. This will be in addition to condition prescribed under Section 438 (2) of the Cr.P.C. (Rajeev Ranjan Prasad, J) avin/- U T
