The petitioner seeks bail in connection with Nokha P.S. Case No. 188 of 2018 registered under Sections 302, 201/34 of the Indian Penal Code and Section 27 of the Arms Act.

As per the first part of the written report, 15 named accused persons including the petitioner are said to have shot at the nephew of the informant and dragged him to quite some distance resulting into his death while in second part of the same, it is alleged that it is the Saroj Singh, Vikash Singh, Kedar Pandey and Manjit Singh had resorted firing upon the deceased.

Patna High Court Cr.Misc. No.79255 of 2018(2) dt.18-01-2019 2/2 It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has no committed no offence. He has been falsely implicated in this case merely because nephew of the petitioner was murdered by the husband of the informant for which Sasaram (M) P.S. Case No. 1360/2015 has been lodged against the informant and others. The allegation levelled against the petitioner is not specific rather general and omnibus. Petitioner happens to be 75 years old. Petitioner has no criminal antecedent and has been languishing in custody since 27.07.2018.

Learned APP opposed the bail prayer of the petitioner.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Rohtas at Sasaram in connection with Nokha P.S.
