Petitioner seeks bail in Jaipur P.S. Case No. 32 of 2018 registered for the offence punishable under Sections 147, 148, 149, 448, 341, 323, 324, 325, 307, 354(B), 504 and 506 of the Indian Penal Code.
Informant in his written complaint has stated that on 16.08.2018 at about 8:30 A.M. FIR named accused including petitioner surrounded him and there is specific allegation against petitioner of causing farsa blow on his head similar allegation of causing head injury by tangi is against Baijnath Das, as a result of which he received a fracture injury on frontal lobe. It has been submitted on behalf of the petitioner that
Patna High Court CR. MISC. No.78482 of 2018(4) dt.07-03-2019 2/3 though there is allegation against two accused of causing injury by sharp cutting weapon on the head of informant but in injury report only one injury has been found on the head and the same is grievous in nature. It has been further submitted on behalf of the petitioner that he has got no criminal antecedent and is in custody since 22.09.2018.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -1, Banka, in connection with Jaipur P.S. Case No. 32 of 2018, with following conditions:- (1)Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.
(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the Court and his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the court below.
(3) If the petitioner tampers with the
