This application is for grant of regular bail in connection with Khodawanpur (Chhaurahi) P.S.Case No.190 of 2019 dated 7.9.2019 for the offences under Sections 399, 402, 414, 465, 47/34 of the Indian Penal Codeand Section 25(1-b)a, 26, 35 of the Arms Act. Recovery of loaded Pistol from petitioner.
Case is under Section 399, 402 and other Sections of the Indian Penal Code and Section 25(1-b)a, 26, 35 of the Arms Act.
Submission of the learned counsel for the petitioner is that he has clean antecedent. He is in custody for three months.
Patna High Court CR. MISC. No.79460 of 2019(2) dt.11-12-2019 2/2 Heard learned A.P.P. , who has opposed the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage, however, once the charge has been framed or the petitioner remained in custody for six months, he is at liberty to renew his prayer for bail. With the aforesaid observation, this application is dismissed.
