The petitioner seeks bail in Rupaspur P.S. Case No. 397 of 2018 (Spl. Case No. 104 of 2018), instituted for the offence under Section(s) 399, 402, 379, 411 of the Indian Penal Code, Sections 25(1-b)a, 26, 35 of the Arms Act, Sections 20 and 22 of N.D.P.S. Act.

It is alleged in the written report that 200 grams of Ganja has been recovered from a TVS Apache Motorcycle belonging to Lallu Kumar. Petitioner was found sitting on the aforesaid Motorcycle.

Counsel for the petitioner submits that petitioner is in custody since 15.9.2018 having clean antecedent. He further submits that co-accused Lallu Kumar has been granted bail by

Patna High Court Cr.Misc. No.6054 of 2019(2) dt.04-02-2019 2/2 coordinate Bench of this Court vide order dated 15.01.2019 passed in Cr. Misc. 80554 of 2018.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-(vii), Patna, Distt. Patna, in connection with Rupaspur P.S. Case No. 397 of 2018 (Spl. Case No. 104 of 2018), subject to the condition that both the bailors will be the close relatives of the petitioner.
