The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 149, 323, 384, 387, 379, 392 & 504 of the Indian Penal Code.
Patna High Court CR. MISC. No.81857 of 2019(2) dt.13-02-2020 2/3 Petitioners are said to have looted paddy crops worth Rs.10,000.00 on the point of country made pistol from the field of the informant and on protest they started slating and demanded extortion of Rs.2,00,000.00 for allowing to cultivate the said land and also threatened him of dire consequences. It is submitted by learned counsel for the petitioners that no such occurrence as alleged ever took place. No incriminating article has been recovered from the conscious physical possession of the petitioners. There is a land dispute between the parties. As a matter of fact, the petitioners' side filed Title Suit No.06 of 2018 against the informant and others and to mount pressure upon the petitioners the informant has lodged this false and frivolous case against the petitioners on altogether concocted and false allegations. Petitioners have no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, West Champaran at Bettiah
