ANJANA MISHRA ORAL ORDER 20-12-2019 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Ekma P.S. Case No.101 of 2019 registered for the offence punishable under Sections 447, 448, 341, 323, 324, 307, 354, 380, 504/34 of the Indian Penal Code. Learned counsel for the petitioners submits that Petitioner Nos.2 to 4 are lady members of the family whereas Petitioner Nos.1 and 5 are the male members, who have been

Though the allegation of assault by Farsa is against Petitioner No.1, no such injury was found on the person of the informant. It is further submitted that the allegation under Section 380 of the I.P.C. is also ornamental in nature and the penal provisions of Section 307 I.P.C. would also not be attracted, as there was no repetition of blows.
Considering the aforementioned facts and circumstances and the nature of allegations and that the petitioners are not having any criminal antecedents, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Saran, in connection with Ekma P.S. Case No.101 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
