====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 02-08-2024 Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner seeks regular bail in connection with Sidhwalia P.S. Case No. 327 of 2021 for the offence registered under Section 364/34 of the I.P.C.
3. As per the prosecution case, Mithu Dubey aged about 21 years son of informant received a telephonic information from mobile number of Sanjeet Sah stating that the co-accused Priyam Devi was calling him. Mithu Dubey went to her house and after that he did not return to his house.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case only on the basis of suspicion that he had called the
Patna High Court CR. MISC. No.3608 of 2024(5) dt.02-08-2024 2/2 victim. Petitioner has no concern with the victim or co-accused. There is inordinate delay of 8 days in lodging the FIR without any plausible explaination. Petitioner has got no criminal antecedent and he is in custody since 14.06.2023. He further submits that similarly situated co-accused namely Priyam Devi has already been granted anticipatory bail by this Court vide order dated 28.08.2023 passed in Cr. Misc. No. 19582 of 2022. Charge-sheet has already been submitted by the police in this case.
5. Learned APP for the State opposes the prayer for grant of regular bail to the petitioner and submits that S.I.T. has been formed in this case for tracing the victim.
6. Considering the submissions on behalf of the parties and the facts and circumstances of the case, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Gopalganj in Sidhwaliya P.S. Case No. 327 of 2021.
