The petitioner has filed the instant application for grant of anticipatory bail apprehending his arrest in a case registered for the offence under section 409 of the Indian Penal Code. As per allegation in the F.I.R, it is stated that the petitioner who was typist cum Clerk in the office did not provide one of the entry register of the year 2013. It was stated that on making enquiry it appeared that the register had been misplaced in course of the whitewashing in the office. It is submitted by learned counsel for the petitioner that the petitioner is a Government servant. There is neither any allegation of tampering with the witnesses nor are the allegations such that there would be any chance of his absconding. It is further stated that subsequently the misplaced

Patna High Court CR. MISC. No.79336 of 2019(2) dt.18-02-2020 2/2 register was found and has been received by the authorities which is evident from Annexure 2 to the bail application. It is finally submitted that the petitioner has no criminal antecedent. The application for bail has been opposed by learned APP for the State.

Having heard learned counsel for the parties in the facts and circumstances of the case and taking into consideration the nature of allegations, the missing register having been found and having been received by the authorities concerned together with the petitioner having no criminal antecedent, this Court is inclined to enlarge the petitioner on bail. The petitioner above named, in the event of his arrest or surrender in the Court below within a period of six weeks from today in connection with Naubatpur P.S. Case No.293 of 2019 is directed to be enlarged on bail on furnishing bail bond of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-II, Danapur, subject to the conditions as laid down in section 438 (2) of Criminal Procedure Code.
