JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-03-2019 The petitioners apprehend their arrest in connection with Nanpur P.S.Case No. 279 of 2018 registered under Sections 363, 366A, 504 and 506/34 of the Indian penal Code. Allegation against the petitioners is of kidnapping the minor daughter of the informant.

Submission of learned counsel for the petitioners is that in her statement recorded under Section 164 Cr.P.C., the girl has not named these petitioners and they have falsely been implicated and as a matter of fact there is love affair in between the daughter of the informant and son of the petitioner no. 1. Heard learned APP also who has opposed the prayer of

Patna High Court CR. MISC. No.4010 of 2019(4) dt.08-03-2019 2/2 anticipatory bail on the ground that names of petitioners are also taken by the witnesses during investigation.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to them rather they should surrender within a period of six weeks from the date of receipt of a copy of this order and make prayer for regular bail, which shall be considered and disposed of on its own merit without being prejudiced by this order, if possible, on the same day.
