JUSTICE ASHUTOSH KUMAR ORAL ORDER 17-01-2019 The petitioner seeks bail in anticipation of her arrest in connection with Buxar (Industrial) P.S. Case No. 208 of 2018, dated 21.10.2018, instituted for the offences under Sections 366A/34 of the Indian Penal Code. The daughter of the informant is alleged to have been regularly stalked by the accused persons including one son of the petitioner. Later, the victim girl was taken to Delhi and was also subjected to rape. On recovery of the

Patna High Court Cr.Misc. No.641 of 2019(2) dt.17-01-2019 2/2 girl, she was made to give her statement under Section 164 Cr.P.C. In the aforesaid statement, she has not stated anything about the petitioner.

Considering the fact that the petitioner is not alleged to have done anything and has been made accused in this case only because of her being the mother of one of the accused persons, she, in the event of her arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, is directed to be released on bail on her furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar, in connection with Buxar (Industrial) P.S. Case No. 208 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
