Petitioners seek pre-arrest bail in Taraiya P.S.Case No.267/18 registered under Section 188, 272, 273, 34 of I.P.C. and Sections 30(a), 38, 41of the Bihar Excise Amendment Act. Allegation is of recovery of 6400 liters spirit from the truck standing near the cane field. The petitioners are named in the F.I.R.
Submission on behalf of the learned counsel for the petitioners is that their names transpired on the basis of confidential information as they were not arrested on the spot and they have no criminal antecedent.
Heard the learned A.P.P. also.
Having heard both sides and in view of the facts and
Patna High Court Cr.Misc. No.78930 of 2018(2) dt.11-01-2019 2/2 circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the learned court below within six weeks from today be released on bail on furnishing bail bonds of Rs.25,000/- each with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-VI-cum-Special Judge (Excise), Saran at Chapra, in Taraiya P.S.Case No.267/18 subject to the conditions as laid down under Section 438(2) of Cr.P.C. and further condition that the bailors must be of local having sufficient movable and immovable properties within the jurisdiction of the court concerned.
