JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-01-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 30(a) of Bihar Prohibition & Excise Act.

Near about 200 bottles containing 60 liters Nepali liquor are said to have been recovered from the possession of the petitioner while he was carrying the aforesaid bottles by a motorcycle. Petitioner is in jail custody since 23.10.2018 and he does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand)

Patna High Court Cr.Misc. No.78819 of 2018(2) dt.18-01-2019 2/2 with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Bettiah, West Champaran in connection with Sikta P.S. Case No. 106 of 2018.
