The petitioner is apprehending his arrest in connection with Dinara P.S.Case no.186 of 2019 registered for offences punishable under Sections 341, 323, 379, 307, 504, 506/34 of the Indian Penal Code.
As per the prosecution case, so far this petitioner is concerned, there is specific allegation of assault by rami on the head of the informant causing injury . Apart from that there is allegation of snatching of Rs.5,000/- , golden chain and other articles.
Submission of the learned counsel for the petitioner is that there is cae and counter case between the parties and the injuries are simple in nature except the injury no.1 and 3 Heard learned A.P.P. and the learned counsel for the
Patna High Court CR. MISC. No.79366 of 2019(2) dt.20-01-2020 2/2 informant, who has appeared suo motu submitting that one of the injuries are of sharp cutting weapon and dangerous to life.. Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court.
With the aforesaid direction, this application is dismissed.
