JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 27-05-2020 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Dhoraiya P.S. Case No. 258 of 2018 for the offence under Sections 147, 341, 323, 325, 307, 504, 379 and 506 of the Indian Penal Code. Later on Section 302 of the Indian Penal Code has been added.
Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 06.08.2019. He submits that the there is delay of four days in lodging the F.I.R., as the incident took place on 01.11.2018 and the F.I.R. was lodged on 05.11.2018. He further submits that the allegation against the petitioner is that he inflicted blow on the leg and not on the vital part of the body.
