2. The petitioner seeks bail in a case registered for the offence under Sections 30(a) and 37(c) of the Bihar Prohibition & Excise Act, 2016.
3. As per the prosecution case, 36 liters of Nepali Liquor has been recovered from the possession of the petitioner.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. He further submits that petitioner is not accused in any case of similar nature and he is in custody since 22.08.2023.
5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the period of custody and the aforesaid facts, this application for regular bail is allowed.
7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge, Excise Court No. 2, Araria/concerned Court below in connection with Kursakanta P.S. Case No. 200 of 2023 subject to the condition that:- 7(1). The petitioner will mark his attendance at the Kursakanta, Araria Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
