JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-01-2020 The petitioner seeks regular bail in connection with Naokothi P.S. Case No. 54 of 2019, registered for offences punishable under Sections 25(1-AA), 25 (1-b)A, 26 and 35 of the Arms Act.

Allegation is of country made pistol and ten live cartridges from the petitioner. Apart from that he is accused in four other cases.

It has been submitted on behalf of the petitioner that he has been in custody for last eight months and now chargesheet has been submitted and one of the co-accused, from whom, there is also recovery of cartridges, has been granted privilege of bail by a coordinate Bench of this Court vide order dated 26.07.2019 passed in Cr. Misc. No. 45773 of 2019 and petitioner has been in judicial custody since 17.05.2019.

Having heard both sides, in view of the submission as above, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Begusarai, in connection with Naokothi P.S. Case No. 54 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds as well as subject to the condition that petitioner has to appear before the Officer-in-Charge of the police station of his area in the first week of each month for a period of six months so that the police may watch his conduct during that period.
