JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-12-2019 Petitioner seeks regular bail in connection with Bettiah Town P.S. Case No. 628 of 2019, registered for the offences punishable under Sections 414/34 of the Indian Penal Code and Section 25(1-b)a, 26 and 35 of the Arms Act. As per F.I.R. police intercepted one motorcycle and petitioner was arrested and two persons succeeded in fleeing away. There is recovery of one loaded country made pistol with one cartridge from the petitioner. He also could not produce any document relating to motorcycle.

Submission of the learned counsel for the petitioner is that he has no criminal antecedent. He has falsely been implicated in this case. He is in custody for more than three and half months.

Having heard both sides, in view of the facts and circumstances, as stated above, at this stage, I am not inclined to grant bail to the petitioner. However, once the charge has been framed in this case against the petitioner or he remains in custody for six months, whichever is earlier, he has to renew his prayer for bail.

With the above observations, this application is dismissed.
