2. Permission is granted.

Hence, the present bail application is dismissed as withdrawn with liberty to the petitioner that petitioner may renew his prayer for regular bail before the Trial Court and the learned trial Court shall consider the prayer for bail of this petitioner on the same day without being prejudiced by this order. Learned Trial Court shall also keep in mind that learned 11th Additional Sessions Judge Kaimur at Bhabhua (Trial Court) in its order dated 12.03.2025 under Section 228(2) of the Cr.P.C mentioned that there is no case made out against the petitioner for the offence punishable under

Patna High Court CR. MISC. No.359 of 2025(3) dt.08-05-2025 2/2 Section 307 and 354 of the I.P.C. Further, the trial Court shall also consider that co-accused Vishnu Kant Mishra @ Golu Mishra has already been granted bail by the Court of S.D.J.M, Mohaniya.
