2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) of Bihar Prohibition and Excise (Amendment) Act 2022 .

3 . It is alleged that 50 liters of country made liquor was recovered from sack which is said to have been thrown by this petitioner.

4. It is submitted that the petitioner is innocent and has falsely been implicated in this case only on the basis of suspicion . No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery . Petitioner has got one criminal antecedent of similar nature in which he is on bail.

6. Considering the facts of the case, in the event of arrest/surrender within eight weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ - XIIth cum Spl. Judge Excise Court No. 1 Gopalganj in connection with Barauli Police Station Case No. 486 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
