2. After discussion with the parties in presence of their counsels, both parties admit that it is now not possible for them to reside together.

3. Counsel for both the parties jointly admit that they cannot continue the said marriage and in case the decree of divorce shall be allowed by way of dissolution of their marriage, both parties have no objection for the same.

4. By way of permanent alimony, the appellant is agreed to pay Rs.20,00,000/- (Rupees Twenty lacs only) as full and final settlement amount and respondent is ready to accept

5. In the light of the conciliation and proposal made, the order dated 15.09.2023 passed in Matrimonial Case No.332 of 2016 is hereby set aside and on the joint request of the parties in presence of their respective counsels, the decree of divorce between the appellant and respondent is hereby affirmed, subject to payment of Rs.20,00,000/- (Rupees Twenty lacs only) by demand draft within 45 days from today, as full and final settlement.

6. It is made clear that from the conjugal life between the appellant and the respondent, there is one daughter, who is presently residing with the mother, this Court in the present settlement has not expressed any interest with regard to the daughter.

7. The present Misc. Appeal is hereby disposed off in light of the aforesaid order.

8. It is made clear that respondent shall withdraw the criminal cases pending against the appellant and shall take every steps for closing of Kishanganj Mahila P.S. Case No.16 of 2016, G.R. No.704/2016, S.G.R. No.704/2016 and Maintenance Case No.90/2016. The application for withdrawal shall be filed upon receiving of the demand draft amounting to Rs.20,00000/-
