The petitioner seeks anticipatory bail in connection with Aurangabad Town P. S. Case No. 120 of 2018, registered for offences punishable under Sections 420, 406, 467, 468, 469, 470, 471, 323, 504/506 and 120 (B) of the Indian Penal Code. Allegation as per F.I.R. against the petitioner is that he along with others under the conspiracy with deceitful intention started a company in the name as " Indus Weir Industries Limited" and published a Memorandum and Articles of Association and money has deposited by the depositors and agents under different scheme but after maturity, the matured amount has not been returned.

Submission of the learned counsel for the petitioner that the petitioner has not committed any offence and dthe

Patna High Court CR. MISC. No.4551 of 2019(3) dt.11-03-2019 2/2 petitioner himself deposited a sum of Rs. 10,000,00/- in the above named company as he also cheated by the company. Learned A.P.P. opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances as discussed above, I am not inclined to grant bail to the petitioner, Accordingly, prayer of anticipatory bail is rejected with a direction to the petitioner that if the petitioner surrender before the court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by this order of this Court. This application is accordingly dismissed.
