2. The petitioner has prayed for bail in connection with Rosera P.S. Case No. 59 of 2025 registered for the offence punishable under Sections 126(2), 115(2), 117(2), 109, 352, 74, 3(5) of the B.N.S., 2023.
3. The case of the prosecution in short is that the petitioner has given an iron rod blow on the head of the informant. It is further alleged that co-accused namely, Mohan Jha also assaulted with an iron rod on the right cheek.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. Learned counsel for the petitioner submits that there is also a counter
Patna High Court CR. MISC. No.86190 of 2025(2) dt.16-12-2025 2/2 version of this case, which was filed prior to this case. It has further been submitted that though the nature of the injury that has been received by the informant is grievous, there is no repetition of the blow which shows that the petitioner was having no intention to commit murder. Moreover, the petitioner is languishing in judicial custody since 07.10.2025.
5. The application for bail is opposed by learned APP for the State and submits that the petitioner is having criminal antecedent of two cases.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, 1st Class, Rosera, Samastipur in connection with Rosera P.S.
