2. The petitioner apprehends arrest in connection with Barsoi PS Case No.146 of 2024 dated 23.07.2024, instituted under Sections 126, 115(2), 118, 74, 324(4), 117(2), 352, 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. The allegation against the petitioner is that he along with another accused assaulted the daughter of the informant by means of sword.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Further submission is that there is specific allegation that the petitioner and co-accused, Sohail, assaulted the daughter of

No.89325 of 2024(3) dt.19-04-2025 2/2 the informant, namely, Budhi Khatoon, with sword and the injury report of Budhi Khatoon shows that she received two injuries; one simple in nature and another grievous but caused by hard and blunt object. Further submission is that both sides are agnates and the matter has been settled between the parties outside the Court and a compromise petition has been filed in the Court below. Lastly, it is submitted that the petitioner has no criminal antecedents.

5. Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, 1st, Katihar, in Barsoi PS Case No.146 of 2024, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

7. The application stands allowed.
