Petitioner seeks bail in Birpur P.S. Case No.35 of 2018 instituted for the offence under Section(s) 498-A, 494, 323, 504/34 Indian Penal Code.

Counsel for the petitioner submits that Petitioner is in custody since 06.09.2018. He is husband of the informant. The informant has alleged that this petitioner with other accused persons has ousted the informant from the house along with her minor child. He is always ready to keep the informant as his wife.

Counsel for the petitioner has submitted that earlier informant has filed a case against the petitioner vide Birpur P.S. Case No.218 of 2016 levelling allegation that he has established

Patna High Court Cr.Misc. No.79951 of 2018(2) dt.17-01-2019 2/2 physical relationship with her on the pretext of performing marriage in which he has been granted bail by co-ordinate Bench of this Court by order dated 10.01.2019 passed in Cr. Misc. No.78863 of 2018.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Birpur, Supaul, in connection with Birpur P.S. Case No.35 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner. (Sanjay Priya, J) J. Alam/- U T
