JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 11-01-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Nauhatta P.S. Case No. 106 of 2018 for the offence under Sections 363, 366 (A)/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He submits that the petitioner was one of the members of the unlawful assembly instrumental in abduction of the daughter of the informant. Learned counsel for the petitioner has drawn the attention of this Court to the statement of the victim recorded under Section 164 of the Cr.P.C. and submits that from the statement of the victim girl recorded under Section 164 of the Cr.P.C., it would appear that the victim has joined the wedlock at her own will with Md. Ajmer. The petitioner is in custody since 28.08.2018.
