JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-01-2019 This application, for grant of anticipatory bail, arises out of Madhubani Town P.S. Case No. 356/2017, disclosing offences under Sections 448, 341, 323, 354, 379, 504/34 of the Indian Penal Code.
Petitioners happen to be sister in law (gotani) and father in law of the informant and allegation against them is that they entered inside the house and tried to disrobe her and when her husband came, they also assaulted him by means of fists and slaps and snatched away Rs. 15,000/-.
Submission of learned counsel for the petitioners is that the dispute with regard to property is between the petitioner no. 2 and his son and due to which, this false and concocted case has been lodged and allegation of trying to disrobe the
Patna High Court Cr.Misc. No.78330 of 2018(2) dt.08-01-2019 2/2 informant is false and concocted and further the petitioner no. 2 has earlier given the information before the police with regard to land dispute.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani, in connection with Madhubani Town P.S. Case No. 356/2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
