JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 17-06-2020 Heard learned counsel for the petitioners and the learned A.P.P. for the State through video conferencing. The petitioners apprehend their arrest in connection with Akbarpur P.S. Case No. 301 of 2019, registered under Section 304(B) and 201/34 of the Indian Penal Code.
The accusation is that informant Chandra Mani Singh performed marriage of his first daughter Priyanka Kumari with Amit Kumar, son of the petitioners, in the year 2003 and due to their wedlock, she was blessed with one male issue, but, she was killed due to non-fulfillment of demand of dowry in the year 2009, but, her in-laws informed that the cause of death is illness. No.81410 of 2019(3) dt.17-06-2020 2/3 marriage of his another daughter, namely, Kanchan Kumari with Amit Kumar in the year 2011 and, subsequently, his second daughter Kanchan Kumari was also blessed with two children, but, she was again tortured by the petitioners being her father-in-law and mother-in-law. On 17.07.2019, informant came to know on mobile about committing murder of his daughter Kanchan Kumari by her father-in-law, mother-in-law (petitioners) and Gotni and her dead body was also disposed of with the help of the villagers.
Learned counsel for the petitioners submits that petitioners are father-in-law and mother-in-law of the deceased and they have no concern with the affairs of the deceased. Further submission is that, in fact, Amit Kumar, husband of the deceased, used to reside at Daman for his livelihood and deceased always used to give pressure to live with her husband at Daman, but, her husband refused to keep the daughter of informant with him due to low remuneration and due to that reason, she committed suicide and on information, the dead body was disposed of in presence of the informant, but informant with ulterior motive lodged the present case.
