JUSTICE VIKASH JAIN ORAL JUDGMENT 10-01-2020 The present application has been filed for a direction to the learned Sub-Judge-IV, Sikarahana "to expedite the trial of Title Suit No. 889 of 2014 and to conclude the same at the earliest."

2. Learned counsel for the petitioner submits that Eviction Suit No. 01 of 2008 was decreed against him and execution proceedings are in progress. The petitioner, on the other hand, has filed Title Suit No. 889 of 2014 in which his evidence has already been concluded and the defendants' examination is going on. It is therefore submitted that the delay in disposal of the title suit would result in irreparable injury to the petitioner.

3. Having regard to the nature of relief sought by the petitioner, no notice appears necessary to the respondents.

4. The petition is disposed of with the observation that the learned court below may in its discretion consider the exigencies for expeditious disposal of Title Suit No. 889 of 2014.
