The petitioner seeks bail in anticipation of his arrest in connection with Riga P.S. Case No. 182 of 2019 dated 03.07.2019 instituted for the offences under Sections 341, 323, 504, 506, 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

The informant claims to have been taken to a Mango orchard and was put in fear of death. When he raised alarm, the miscreants managed to run away but one Nitu Thakur was arrested. He appears to have disclosed the name of the petitioner also.

Considering the fact that nothing has been recovered from the possession of the petitioner and the offence could not be completed in as much as nobody

Patna High Court CR. MISC. No.80536 of 2019(2) dt.16-12-2019 2/2 appears to have been injured even when firing was resorted to, the implication of the petitioner thus is stated to be only on the basis of suspicion.

One of the accused persons having similar allegation against him has been granted the privilege of anticipatory bail.

Considering the aforestated facts and the clean antecedents of the petitioner, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Sitamarhi in connection with Riga P.S. Case No. 182 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C.
