The petitioners seek bail in Barhara P.S. Case No. 405/2018, instituted for offences under Section(s) 414, 120(b), 34 of the Indian Penal Code read with Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
It is alleged in the written report that 400 litres of illicit country made liquor has been recovered from a white colour car. The petitioners were arrested on the ground that they were standing near the car. Petitioner is neither owner nor driver of aforesaid car.
It has been submitted on behalf of petitioners that they are neither owner nor driver of the vehicle.
Patna High Court Cr.Misc. No.906 of 2019(5) dt.06-02-2019 2/2 Petitioners are in custody since 10.10.2018 having clean antecedent.
Considering the aforesaid facts and circumstances, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned 4th A.D.J.- cum- Special Judge, Excise, Bhojpur, Ara in connection with Barhara P.S.
