Heard Sri Ashok Kumar Jha, learned counsel for the petitioner and Sri Devendra Kumar, learned counsel for the informant as well as Sri Chandra Bhushan Prasad, learned APP for the State.

Petitioner seeks anticipatory bail in Complaint Case no. CI-241 of 2018 in which cognizance has been taken under section 498A of the Indian Penal Code.

Learned counsel for the petitioner submits that opposite

Patna High Court CR. MISC. No.79442 of 2019(4) dt.25-10-2021 2/2 party no.2 had filed Maintenance Case no. 198/2019 before the Principal Judge, Family Court, Sitamarhi in which a sum of Rs 3,50,000/- by way of one time settlement was granted to opposite party no.2 by order dated 01.04.2021. Learned counsel for the informant agrees with submission of learned counsel for the petitioner and submits that since one time settlement has been made as such he is not opposing the anticipatory bail application.

Considering the facts and circumstances of the case, this anticipatory bail application is allowed. In the event of arrest/surrender within ten weeks from today, the petitioner is directed to be released on anticipatory bail on furnishing bail bonds of Rs 5,000/- (five thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Pupari at Sitamarhi in CI-241 of 2018 subject to the condition under section 438(2) Cr.P.C.
