In this case, the petitioner is seeking anticipatory bail in connection with Rajaun P.S. Case No.383 of 2019, registered for the offence punishable under Sections 341, 323, 307, 337, 504/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation has been made that the co-accused including the petitioner surrounded the informant's son and started assaulting causing injury to him, however, counsel for the petitioner submits that there is case and counter case between the parties and the report, which is Annexure-2, 3 & 4, does not support the prosecution case.

Patna High Court CR. MISC. No.78812 of 2019(2) dt.04-12-2019 2/2 Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, if the petitioner surrenders before the Court below within four weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order preferably on the same day without being influenced by the order of this Court.
