JUSTICE BIRENDRA KUMAR ORAL ORDER 22-01-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Trial No.1699 of 2018 arising out of Govindganj P.S. Case No.21 of 2006 corresponding to G.R. Case No.322 of 2006 registered for the offence punishable under Sections 363, 366(A), 34 of the Indian Penal Code. Submission is that though there is allegation of abduction of a married lady aged about 20 years. However, the police did not send up the petitioners for trial after investigation and the victim was examined during trial but she has also not whispered against the petitioners.

Considering the facts aforesaid, let the petitioners,

Patna High Court Cr.Misc. No.79399 of 2018(2) dt.22-01-2019 2/2 above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.20000/- (Twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-14, East Champaran at Motihari in connection with Trial No.1699 of 2018 arising out of Govindganj P.S. Case No.21 of 2006 corresponding to G.R. Case No.322 of 2006, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully co-operate with the investigation/trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner.
