2. This is an application for quashing of the order dated 17.10.2017 passed by J.M. Patna City in Fatuha P.S. Case No. 261/17 by which the Court below has taken cognizance under Sections 302, 201, 120B/34 of the IPC.

3. It has very fairly been submitted by the learned counsel for the petitioner that the trial is proceeding in the matter.
