2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 376, 504 and 506 of the Indian Penal Code and Sections 8 and 12 of the POCSO Act.
3. As per prosecution case, on the alleged date and time of occurrence, while father of informant was away from house, in the meantime, this petitioner came at his house and asked for helmet. While informant was searching for helmet, this petitioner entered into house and raped her.
4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is innocent and has falsely
Patna High Court CR. MISC. No.279 of 2025(2) dt.04-02-2025 2/2 been implicated in this case with ulterior motive. No such occurrence, as alleged in the F.I.R., ever taken place. Petitioner claims clean antecedents.

On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that petitioner is named in the F.I.R. and there is specific and direct accusation that he committed rape upon the informant. It is further submitted that during investigation, the victim/informant has corroborated the offence committed by this petitioner and stated that this petitioner established physical relations with her without her consent and also threatened her not to disclose the incident. The medical examination report shows that no external injuries were found on the body of the victim but hymen was found partially ruptured.
6. Considering the aforesaid facts and circumstances, specific and direct nature of accusation and statement of the victim, the prayer for grant of anticipatory bail to the petitioner is rejected.
