2. The petitioner has prayed for bail in connection with Rania Talab P.S. Case No. 453 of 2024 registered for the offence punishable under Section 310(2) of the B.N.S.
3. The case of the prosecution, in short, is that while the informant was returning from a marriage ceremony on his car along with his companions, 5-6 unknown miscreants on two bikes stopped his car near village Jitan Chhapra and looted mobile phone and cash.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has
Patna High Court CR. MISC. No.86279 of 2025(2) dt.17-12-2025 2/3 committed no offence. He has been falsely implicated in this case. The F.I.R. was lodged against unknown miscreants. The name of this petitioner has surfaced during course of investigation in the confessional statement of co-accused Sunny Kumar and Sudhir Kumar. It has further been submitted that nothing has been recovered from his possession. It has also been submitted that from perusal of the F.I.R., it is clear that the informant claims that he can identity the miscreants but no T.I.P. has been conducted. It has also been submitted that co-accused Sunny Kumar and Sudhir Kumar have been granted bail by learned Co-ordinate Bench of this Court vide Cr. Misc. No. 21888 of 2025 and 47780 of 2025 respectively. The case of this petitioner stands on better footing. Petitioner is languishing in judicial custody since 14.09. 2025.
5. Learned APP appearing for the State has vehemently opposed the application for bail and has submitted that petitioner is having criminal antecedent of three cases.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties
