The petitioner seeks regular bail in connection with Motihari Town P.S. Case No. 262 of 2018 registered for the offence punishable under Sections 420, 406, 379/34 and 120B of the Indian Penal Code and Section 66 of the I.T. Act. The allegation is regarding the accused persons having changed the A.T.M. card and used the same for illegal withdrawal of money as also illegal transfer of money from the account of the informant to the account of other person as also for withdrawal of money in an illegal manner. The learned counsel for the petitioner submits that the petitioner is not named in the FIR and he has been remanded in

Patna High Court Cr.Misc. No.2837 of 2019(2) dt.22-01-2019 2/2 the present case when he was arrested in connection with Motihari Town P.S. Case No. 381 of 2018. It is further submitted that similarly situated co-accused persons have already been granted by orders dated 04.12.2018 and 10.12.2018 passed in Criminal Misc. No. 71048 of 2018 and Criminal Misc. No. 71491 of 2018. It is further submitted that no recovery has been made from the possession of the petitioner and the petitioner is languishing in custody since 24.07.2018. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Motihari Town P.S. Case No. 262 of 2018.
