JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-01-2020 This application, for grant of anticipatory bail, arises out of Karja P.S. Case No. 239 of 2019, disclosing offences under Sections 365, 366 and 34 of the Indian Penal Code.

As per F.I.R. allegation against the petitioners is of kidnapping the daughter of informant.

Submission of learned counsel for the petitioners is that the girl has been recovered and her statement under Section 164 Cr.P.C. has been recorded, in which, she disclosed that both the petitioners called her and took her to Chennai, where, they kept the girl for twenty days and, thereafter, they left her at Muzaffarpur and apart from that no other allegation of any overt

Patna High Court CR. MISC. No.80280 of 2019(3) dt.20-01-2020 2/2 act has been mentioned. Further submission is that the girl is major, which will appear from her statement under Section 164 Cr.P.C. as well as the F.I.R.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Muzaffarpur, in connection with Karja P.S. Case No. 239 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
