====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 23-01-2019 Heard the learned counsel for the petitioners and the State.

The petitioners seek bail in anticipation of their arrest in connection with Gwalpara P.S. Case No. 4 of 2018 dated 16.01.2018 instituted for the offences under Sections 341, 342, 448, 323, 325, 354(B), 379, 504, 506 and 34 of the Indian Penal Code.

Though the petitioners are alleged to have tied the informant with a rope and assaulted him and also tried to commit some physical misdemeanor with the female member of the house but learned counsel for the petitioners has submitted that the aforesaid allegations have been levelled because of the pending land dispute which would be evident from the narration made in the FIR. The petitioners hail from the same village and

Regard being had to the aforesaid facts viz. the nature of accusation against the petitioners and they being persons of clean antecedents, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Ist Class, Udakishunganj, Madhepura in connection with Gwalpara P.S. Case No. 4 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
