JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2019 Earlier the prayer for bail of the petitioner was rejected vide order dated 01.08.2018 passed in Cr. Misc. No. 36259 of 2018 along with Cr. Misc. No. 32013 of 2018. The petitioner seeks regular bail in connection with Nawada Town P.S. Case No. 15 of 2018, registered for the offences punishable under Section 364/34 of the Indian Penal Code subsequently added Sections 302, 201, 120B of the Indian Penal Code.

Allegation against the petitioner along with other accused persons is that they boarded the deceased in a Bolero vehicle and taken him away and thereafter the body of the deceased was recovered.

Submission of learned counsel for the petitioner is that other co-accused persons having similar allegation have

Patna High Court Cr.Misc. No.78765 of 2018(2) dt.16-01-2019 2/2 been granted bail by a Coordinate Bench of this Court vide order dated 03.12.2018 passed in Cr. Misc. No. 66477 of 2018. Further the petitioner has no criminal antecedents. Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case, I am not inclined to grant bail to the petitioner, however once the case has been committed to the Court of Sessions and charge is framed, petitioner is at liberty to renew his prayer for bail after framing of charge and the learned court below is directed to expedite the commitment of the case. Accordingly, this application is dismissed.
