The petitioner, who is in custody since 01.10.2019 seeks bail in connection with Gamharia P.S. Case No. 153 of 2019 dated 27.08.2019 instituted for offence under Section 392 of the Indian Penal Code.

As per prosecution version, the informant was waylaid by the four persons on road. However, the informant in the First Information Report has named the petitioner and one Mukesh Kumar.

Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.80780 of 2019(4) dt.04-06-2020 2/2 that aforesaid Manoj Kumar has been granted bail by a Bench of this Court vide Criminal Miscellaneous No. 82225/2019. He has further submitted that the said Manoj Kumar after his arrest, made his confession before the police leading to recovery of stolen motorcycle from the house of aunt of said Manoj Kumar. It has also been submitted that there does not appear to be recovery of any incriminating material from the possession of the petitioner and because of local village politics, he has been named in the Fist Information Report. In one case in which, the petitioner was earlier made accused, he is stated to be on bail. Considering the aforesaid aspect of the matter, the petitioner is directed to be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Madhepura, in connection with Gamharia P.S. Case No. 153 of 2019.
