JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 16-01-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Barachatti P.S. Case No. 150 of 2007 for the offenses under Sections 147, 148, 149, 436, 427, 379 of the Indian Penal Code and Sections 3,4 and 5 of Explosive Substances Act and Section 17 of the CLA Act.

Learned counsel for the petitioner would submit that in the instant case the 100 persons have been made accused and the name of the petitioner is at Sl. No. 39. There is general and omnibus allegation against all the accused persons. The petitioner has no criminal antecedent.

Considering the fact that the petitioner has no criminal antecedent and there is general and omnibus allegation against
