====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 06-12-2019 Heard learned counsel for the petitioners and learned A.P.P. for the State.
The petitioners are apprehending their arrest in a case for the offence registered under Sections 147, 341,323, 504,324, 307 and 337 of the IPC.
The prosecution story, in brief, is that on 17.09.2017 at about 1.00 P.M., the informant was sitting in the house, in the
Patna High Court CR. MISC. No.80226 of 2019(2) dt.06-12-2019 2/3 meantime, co-accused Sanjay Paswan escaped the she-goat of the informant and claimed the said land belongs to him. When the grand-son of the informant protested, he was also assaulted. When his son Babloo Paswan came to rescue him, co-accused persons Sanjay Paswan, Pawan Paswan, Murari Paswan, Biro Paswan alongwith Nageshwar Paswan assaulted him. Rajiv Paswan, Rakesh Kumar, Diwakar Kumar, Laxman Paswan, Ramtaji Paswan, Rajendra Paswan @ Raju Paswan assaulted with Iron rod, Lathi, Bhala and Farsa as a result of which, sons of informant, Binod Paswan, Babloo Paswan, Dilip Paswan received injuries on their head. Thereafter, the petitioners and others climbed on the roof and pelted bricks on the informant and others as a result of which, they sustained injuries. They also assaulted his daughter Rani Devi @ Sulekha Devi and Aarti Devi after entering into the house.
It has been submitted by learned counsel for the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. The allegation of assault is against co-accused Sanjay Paswan, Pawan Paswan, Murari Paswan and Biro Paswan. As far as petitioners are concerned,
Patna High Court CR. MISC. No.80226 of 2019(2) dt.06-12-2019 3/3 they are ladies. There is no allegation of assault against the petitioners.
On behalf of the learned counsel for the State, it has been submitted that the petitioners are named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioners above named, in the event of arrest or surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M. Lakhisarai, in connection with Halsi P.S. Case No. 88 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
