2. The petitioner has prayed for bail in connection with Dhanarua P.S. Case No. 326 of 2024 registered for the offence punishable under Sections 395 and 397 of the Indian Penal Code.

3. The case of the prosecution in short is that some unknown miscreants have looted cash of Rs. 28,100/- from the cash counter and also took away a mobile phone.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. Learned counsel for the petitioner submits that from perusal of the order of the learned trial court, it will transpire

Case No. 494 of 2024 and his name has surfaced in this case on the basis of confessional statement of co-accused. He also submits that nothing has been recovered from the possession of this petitioner. It has also been submitted that co-accused having similar nature of allegation namely, Ghanshyam Bharti has been granted bail by learned coordinate Bench of this Court in Cr. Misc. No. 51338 of 2025. He further submits that the petitioner is languishing in judicial custody since 04.07.2025.

5. The application for bail is opposed by learned APP for the State and submits that the petitioner is having criminal antecedent of ten cases.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail with the conditions that one of the bailors will be a close relative of the petitioner and the petitioner will remain present on each and every date fixed by the learned trial court and in case of absence of three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the trial court itself. The above named petitioner is directed to be enlarged on bail on furnishing bail
